SMS & Messaging Policy
1. Program Description
Marni's Bar & Grill operates a text messaging program to provide reservation confirmations and reminders, order updates, marketing offers, loyalty program updates, and event invitations to customers who have opted in.
2. Opt-In
You opt in by:
- Providing your mobile number on a reservation, order, or loyalty enrollment form and affirmatively checking a consent box
- Texting a keyword (e.g., JOIN) to our shortcode or 10DLC number
- Verbally agreeing during a phone reservation and confirming via reply text
By opting in, you confirm that you are at least 18 years old, that the mobile number you provided is your own, and that you consent to receive automated text messages from us.
Express Written Consent for Marketing Messages: By opting in to our marketing text program, you provide your express written consent (as defined by the Telephone Consumer Protection Act, 47 U.S.C. § 227) to receive automated marketing text messages from Marni's Bar & Grill at the mobile number you provided. This consent is not a condition of any purchase or service. You understand that marketing messages may be sent using an automatic telephone dialing system or prerecorded voice.
Separate Consent for Transactional vs. Marketing Messages: Consent to receive transactional messages (reservation confirmations, order updates) is obtained separately from consent to receive marketing messages (promotions, offers, event invitations). You may opt out of marketing messages while continuing to receive transactional messages related to active orders or reservations.
3. Message Frequency
Message frequency varies. You may receive transactional messages (reservations, orders, confirmations) as those events occur, and up to 4–6 marketing messages per month.
4. Message and Data Rates
Message and data rates may apply. You are responsible for charges from your wireless carrier.
5. Opt-Out
You may opt out at any time by replying STOP to any of our text messages. You will receive a final confirmation message, after which we will no longer send messages to that number unless you opt back in.

We also honor the following opt-out keywords: STOP, UNSUBSCRIBE, CANCEL, END, QUIT. Opt-out requests are processed within 24 hours. After opting out, you will not receive further marketing messages; however, you may receive a final confirmation of your opt-out and any transactional messages related to pending orders or reservations.
6. Carriers
Carriers are not liable for delayed or undelivered messages. We make commercially reasonable efforts to deliver messages but cannot guarantee delivery.
Supported carriers include but are not limited to AT&T, T-Mobile, Verizon, and other major U.S. carriers. Carrier support is subject to change.
7. Privacy
We do not sell, rent, or share your mobile number with third parties for their independent marketing. We may share your number with vendors that help us operate the program (e.g., SMS platform providers), and as described in our Privacy Policy.
8. Eligibility
Our SMS program is open to U.S. mobile numbers only. International numbers are not supported at this time.
9. Changes
We may update this SMS Policy from time to time. Material changes will be communicated to active subscribers.
10. Compliance
Our SMS program operates in compliance with the Telephone Consumer Protection Act (TCPA), CTIA Messaging Principles and Best Practices, and A2P 10DLC carrier requirements.
To the extent our messaging program includes MMS or multimedia content, it also complies with applicable CTIA content guidelines. Consent records (including the method of opt-in, date/time, and the specific language presented at opt-in) are retained for at least five (5) years after the date of consent or the date of the last message sent pursuant to that consent, whichever is later.
